ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your use of the Daily Peptide mobile application ("the App," "Daily Peptide," "we," "our," "us"). By creating an account or using Daily Peptide, you agree to be bound by these Terms.

By creating an account or using Daily Peptide, you agree to:

Age Requirement

You must be at least 13 years old to use Daily Peptide.

If you are between 13-18 years old, you must have parental/guardian consent to use this app.

Changes to Terms

We may modify these Terms at any time. Changes become effective when posted. Continued use after changes = acceptance of new Terms.

1. DESCRIPTION OF SERVICE

1.1 What Daily Peptide IS

Daily Peptide is a personal tracking and organizational tool for:

  • Creating custom schedules and reminders

  • Logging health and wellness data

  • Performing mathematical calculations

  • Visualizing your logged data

  • Syncing data across your devices

1.2 What Daily Peptide IS NOT

Daily Peptide is NOT:

  • A medical device

  • A diagnostic tool

  • A prescription or recommendation system

  • A substitute for professional medical advice

  • A patient-provider communication platform

  • Approved by FDA, EMA, or any regulatory body

2. MEDICAL DISCLAIMER

2.1 No Medical Advice

CRITICAL: Daily Peptide does NOT provide medical advice, diagnosis, or treatment.

DO NOT RELY ON THIS APP FOR ANY MEDICAL PURPOSES.

You understand and agree that:

  • The app is for personal record-keeping ONLY - it is a convenience tool, NOT a medical tool

  • No content, feature, calculation, or output in the app constitutes medical advice

  • You must consult qualified healthcare professionals for ALL medical decisions

  • We do NOT recommend, endorse, or verify any doses, protocols, or treatment plans

  • All calculations are for mathematical reference ONLY and must be verified by your healthcare provider

  • Reminders and notifications are convenience features ONLY - do NOT rely on them for critical timing

  • AI features provide estimates ONLY - do NOT rely on them for nutritional or dietary decisions

2.2 User Responsibility

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR:

  • Consulting qualified healthcare professionals before starting, stopping, or modifying ANY therapy or treatment

  • Following ONLY protocols prescribed by licensed medical providers

  • Verifying ALL calculations, schedules, and data with your healthcare provider before use

  • Monitoring your health and reporting adverse effects to your doctor immediately

  • NOT relying on app reminders, notifications, or calculations for critical medical decisions

  • Using additional backup methods (alarms, calendars, written notes) for important reminders

  • Complying with all applicable laws regarding substances in your jurisdiction

  • Ensuring accuracy of all data you enter

  • All consequences, outcomes, and effects resulting from your use of this app

2.3 Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • Use of this app involves inherent and substantial risks

  • You use the app ENTIRELY at your own risk

  • We are NOT liable for ANY health outcomes, adverse effects, or consequences

  • You will hold us harmless for ANY and ALL consequences arising from your use

  • We accept ZERO responsibility for missed doses, incorrect calculations, failed notifications, or data errors

  • You assume FULL responsibility for all medical decisions and health outcomes

  • This app is provided as a convenience tool ONLY - you should NOT rely on it for critical functions

  • You will use additional safety measures and backup systems for important health management

3. USER ACCOUNTS

3.1 Account Creation

To use Daily Peptide, you must:

  • Provide accurate information (name, email, age)

  • Maintain confidentiality of your password

  • Notify us of unauthorized access

  • Be responsible for all activities under your account

3.2 Account Security

You agree to:

  • Use a strong password

  • Not share your account credentials

  • Log out on shared devices

  • Notify us immediately of security breaches

We are NOT liable for unauthorized access due to your negligence.

3.3 Account Termination

You may terminate your account anytime via Settings → Account → Delete Account.

We may terminate your account if you:

  • Violate these Terms

  • Engage in fraudulent activity

  • Use the app for illegal purposes

  • Abuse our services

Upon termination:

  • All your data will be permanently deleted within 30 days

  • You lose access immediately

  • No refunds (if applicable to future paid features)

4. USER CONDUCT

4.1 Acceptable Use

You agree to use Daily Peptide for lawful purposes only.

Prohibited Activities:

  • Using the app to facilitate illegal activities

  • Attempting to hack or compromise security

  • Reverse engineering the app

  • Uploading malware or malicious code

  • Impersonating others

  • Harassing other users

  • Violating intellectual property rights

  • Collecting other users' data

4.2 Content You Create

You are responsible for:

  • All data you enter (schedules, logs, notes)

  • Accuracy of your information

  • Compliance with laws in your jurisdiction

You grant us a limited license to:

  • Store your data on our servers

  • Process your data for app functionality

  • Back up your data for security

We will NOT:

  • Sell your data

  • Share your data without consent

  • Use your data for advertising

5. INTELLECTUAL PROPERTY

5.1 Our Property

Daily Peptide and all content (code, design, text, graphics, logos) are owned by Daily Peptide LLC.

Protected by:

  • Copyright laws

  • Trademark laws

  • Intellectual property laws

You may NOT:

  • Copy, modify, or distribute our code

  • Use our trademarks without permission

  • Create derivative works

  • Reverse engineer the app

5.2 Your Data

You retain ownership of all data you enter.

You grant us a non-exclusive, worldwide license to:

  • Store your data

  • Process your data for app functionality

  • Display your data back to you

This license ends when you delete your account.

6. DATA AND PRIVACY

6.1 Data Collection

By using Daily Peptide, you consent to data collection, use, and transfer as described.

6.2 Data Storage

Your data is stored:

  • Locally on your device (Hive + Drift)

  • Cloud storage (Firebase + Supabase)

  • Encrypted in transit and at rest

6.3 Data Deletion

You can delete:

  • Individual logs (swipe to delete)

  • Entire account (Settings → Delete Account)

Upon deletion:

  • Data removed within 30 days

  • Permanent and irreversible

  • No backups retained after 30 days

7. DISCLAIMER OF WARRANTIES

7.1 "AS IS" Basis

Daily Peptide is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We disclaim all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy or reliability

  • Non-infringement

  • Uninterrupted or error-free operation

7.2 No Guarantee

We do NOT guarantee:

  • The app will be error-free

  • Bugs will be fixed promptly

  • Data will never be lost

  • Services will be available 24/7

  • Results from using the app

7.3 Calculator Disclaimer

CRITICAL: Mathematical calculator is for reference ONLY - DO NOT RELY ON IT

You understand and agree that:

  • We do NOT guarantee accuracy of any calculations

  • Calculations may contain errors, bugs, or inaccuracies

  • YOU MUST verify ALL calculations with your qualified healthcare provider before use

  • Calculator is NOT a substitute for professional medical guidance

  • Calculator results should NOT be used to determine doses, protocols, or treatment plans

  • We are NOT liable for incorrect calculations or adverse outcomes from calculator use

  • You use the calculator ENTIRELY at your own risk

  • You assume FULL responsibility for verifying all mathematical outputs

8. LIMITATION OF LIABILITY

8.1 No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We accept ZERO liability and are NOT responsible for ANY damages arising from:

  • Use or inability to use the app

  • Health outcomes, adverse effects, or medical consequences of any kind

  • Errors, omissions, bugs, or inaccuracies in the app, calculations, or data

  • Incorrect calculations or mathematical errors

  • Missed, late, or failed reminders or notifications

  • Data loss, corruption, or sync failures

  • Unauthorized access to your account

  • Reliance on ANY app content, feature, calculation, or output

  • Third-party services (Firebase, Supabase, Google) or their failures

  • Software bugs, crashes, or technical malfunctions

  • Changes or discontinuation of app features

  • Your medical decisions or treatment choices

8.2 Types of Damages

We are NOT liable for:

  • Direct damages

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Punitive damages

  • Loss of profits

  • Loss of data

  • Medical expenses

  • Emotional distress

8.3 Cap on Liability

IF LIABILITY IS FOUND (despite above disclaimers):

Our total liability is limited to $50 USD (or amount you paid for premium features, if any).

8.4 Essential Purpose

These limitations apply even if remedies fail their essential purpose.

9. INDEMNIFICATION

9.1 You Agree to Indemnify Us

You agree to defend, indemnify, and hold harmless:

  • Daily Peptide LLC

  • Our officers, directors, employees

  • Our affiliates and partners

From any claims arising from:

  • Your use of Daily Peptide

  • Your violation of these Terms

  • Your violation of laws

  • Your violation of third-party rights

  • Health outcomes from your decisions

  • Data you enter or upload

9.2 Your Responsibility

You will:

  • Pay all costs of defense (attorneys' fees, court costs)

  • Cooperate with our defense

  • Not settle without our written consent

10. THIRD-PARTY SERVICES

10.1 External Services

Daily Peptide uses third-party services:

  • Firebase (Google) - Authentication, storage

  • Supabase - Database

  • Google Gemini AI - Optional meal estimation

These services have their own terms:

You agree to their terms when using their features.

10.2 No Liability for Third Parties

We are NOT responsible for:

  • Third-party service failures

  • Changes to third-party services

  • Third-party data breaches

  • Third-party terms violations

11. GOVERNING LAW

11.1 Jurisdiction

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes shall be resolved in:

  • Courts of Delaware, United States

You consent to personal jurisdiction and venue in these courts.

11.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action, collective action, or representative proceeding.

12. MISCELLANEOUS

12.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding Daily Peptide.

Supersedes all prior agreements, discussions, or representations.

12.2 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

12.3 Waiver

Our failure to enforce any right does NOT waive that right.

12.4 Assignment

You may NOT assign these Terms. We may assign our rights without notice.

12.5 No Partnership

These Terms do NOT create a partnership, agency, or employment relationship.

12.6 Force Majeure

We are NOT liable for delays due to circumstances beyond our control (e.g., natural disasters, internet outages, pandemics).

13. APP UPDATES

13.1 Updates and Changes

We may:

  • Update the app at any time

  • Add or remove features

  • Change functionality

  • Discontinue the app entirely

Without notice or liability.

13.2 Required Updates

You agree to:

  • Keep the app updated

  • We may require updates for continued use

  • Old versions may stop working

14. SUSPENSION AND TERMINATION

14.1 We May Suspend or Terminate

We may suspend or terminate your access:

  • For violations of these Terms

  • For illegal activities

  • For security reasons

  • For technical reasons

  • At our sole discretion

14.2 Effect of Termination

Upon termination:

  • Your license to use the app ends

  • Your data may be deleted

  • You must stop using the app

  • Provisions that should survive (disclaimers, liability) remain in effect

  • Agreed to assume all risks associated with using this app

  • Agreed that you are solely responsible for all medical decisions

  • Understood that you must consult qualified healthcare professionals for medical guidance
